California Enacts the 2022 UCC Amendments

On September 22, 2023, California enacted the 2022 amendments to the Uniform Commercial Code (UCC) with an effective date of January 1, 2024. The UCC amendments are intended to deal with emerging technology and provide more certainty in the law around transfers and financing of digital assets.
On September 22, 2023, California enacted the 2022 amendments to the Uniform Commercial Code (UCC) with an effective date of January 1, 2024.
The enacted version of the 2022 amendments to the UCC substantially reflects the official text of the UCC amendments approved in 2022 by the Uniform Law Commission and the American Law Institute (Proposed 2022 UCC Amendments), with some minor exceptions. The most notable is the omission of UCC §§ 2-203 and 2A-203.
The Proposed 2022 UCC Amendments are intended to deal with emerging technology and provide more certainty in the law around transfers and financing of digital assets.
